CJEU rules in favor of MYFLYRIGHT

MYFLYRIGHT has achieved a historical victory for air passenger rights before the Court of Justice of the European Union (CJEU) in the case against Corendon Airlines Turistik Hava Tasimacilik AS vs. Myflyright GmbH (C-558/24). The Court ruled that airlines cannot avoid paying monetary compensation by changing scheduled flight times shortly before the departure time of the flight.

The case concerned a Corendon Airlines flight from Munich to Antalya, which was postponed the day before departure but ultimately arrived more than three hours later than originally planned. The CJEU confirmed that under Regulation (EC) No 261/2004, the delay must be calculated based on the originally scheduled arrival time, even when the airline announces new timings prior to said flight.

This judgment closes a significant loophole that could have allowed many airlines to circumvent compensation obligations by rescheduling their flights. It strengthens the uniform protection of passenger rights across the European Union and provides clear legal guidance for both parties – passengers and airlines.
